What is personal data?

The subject of data protection is personal data. This is defined in the Federal Data Protection Act. Accordingly, these involve individual details concerning personal or factual circumstances of a specific or identifiable natural person. This includes details such as your name, mailing address, e-mail address or phone number, or possibly also usage data such as your IP address.

We only collect, process, use and forward your personal data if it is permitted by law or if you provide your consent.

WHICH PERSONAL DATA DO WE COLLECT WHEN YOU VISIT OUR WEBSITE, AND FOR WHAT PURPOSE?

Access data/server log files

We automatically collect and store in our server log files information that your browser transmits to us. These are:

  • Browser type/version
  • operating system used
  • Referrer URL (the website previously visited)
  • Host name of the accessing computer (IP address)
  • Time of the server inquiry.

We cannot attribute this data to particular persons. A combination of this data with other data sources does not occur, the data is deleted after a statistical evaluation for the purpose of operation and security.

Contact

We collect your personal data if you provide us with your consent to do so (e.g. by e-mail or by contact form). The data entered by you in our contact form will be sent to our service for processing your request and stored as long as it is necessary for processing. Afterwards, the data is deleted. No other storage or processing takes place.

The extent we use our contact form to request information that is not required to establish contact, we have always marked it as optional. These details serve us to further specify your inquiry and to improve the processing of your request. Providing this information takes place expressly on a voluntary basis and with your consent. If this involves information on communication channels (e.g. e-mail address, phone number), you also agree that we may contact you via this communication channel in order to respond to your request.

You can of course revoke your declarations of consent at any time in the future. Please contact our data protection officer, whose contact details you will find below.

Registration function

The data entered during registration will be used for the purpose of using the service. The data collected can be seen in the input screen during registration.

If you instruct us to provide a service or to send you goods, we will only collect and store your personal data to the extent necessary for provision of the service or performance of the contract. For this purpose, it may be necessary to forward your personal data to companies that we use to provide the service or to fulfill the contract. These are, for example, forwarding companies or other service providers.

After complete contract processing, your data will be blocked and deleted after expiry of the fiscal and commercial law regulations, unless you have expressly agreed to further use of data.
If you have subscribed to our newsletter with your e-mail address, we will also use your e-mail address for our own advertising purposes beyond performance of contract until you unsubscribe from the newsletter.

Cookies

We also use so-called cookies for data collection and storage in accordance with Article 6 Section 1 letter f. Cookies are small data packets that your browser stores at our request in your device. INTEGRATION OF THIRD-PARTY SERVICES AND CONTENT (YOUTUBE, RSS ETC.)

We may include third-party content, such as YouTube videos and RSS feeds. This always requires that the providers of this content (hereinafter referred to as “third party providers”) log your IP address, as they cannot send the content to your browser without the IP address. The IP address is therefore required for the display of this content. We endeavor to use only the content whose respective providers use the IP address only for delivering the content. We have no influence, however, on whether the third-party providers store the IP address, e.g. for statistical purposes, and inform you according to our level of knowledge.

Newsletter

With the newsletter we inform you about our company and our offers. If you would like to receive the newsletter, we require a valid email address from you, confirmation that you are the owner of the specified email address and that you agree to receive the newsletter. Further data is not collected. The e-mail address provided by you will be stored by us for the purpose of sending the newsletter. As soon as you unsubscribe from the newsletter, it is deleted. When you register for the newsletter, we save your IP address and the date of registration. This storage serves only to document our correction. You can unsubscribe from the newsletter at any time, either by a link in the newsletter itself or by notifying us, thus revoking your consent to receive the newsletter, effective in the future.

Job Applications

The data entered by you in our contact form is sent to our human resources department (LOTUS GmbH & Co. KG) for processing your request. After processing your application, the data will be deleted after the legal objection period has expired. There is no other storage or processing of your data. Purpose-related use of data and forwarding to third parties

We observe the principle of purpose-related data use, and we collect, process and store your personal data only for the purposes for which you have informed us. Your personal data will not be forwarded to third parties without your express consent, unless this is necessary to provide the service or to execute the contract. Also the transmittal to government institutions and authorities entitled to information shall only take place within the scope of the statutory duties to provide information or if we are obliged to provide information by a court decision.
We also take internal data protection very seriously. Our employees and the service companies hired by us have been obliged by us to maintain confidentiality and to comply with data protection regulations.

Forwarding of your data to third countries

Your personal data will not be forwarded to third countries (Countries outside the European Economic Area – EEA) without your express consent, unless this is necessary to provide the service or to execute the contract.

Right of objection and revocation

According to Art. 21 GDPR, you have the right to object at any time to the processing of your personal data based on Art. 6 Sect. 1 a GDPR (data processing based on your consent) and Art. 6 Sect. 1 b of GDPR (data processing for the fulfillment of contractual obligations). Rights of persons concerned

You have the right to information according to Art. 15 GDPR, the right to correction according to Art. 16 GDPR, the right to cancellation according to Art. 17 GDPR, the right to limitation of processing according to Art. 18 GDPR and the right to data transferability according to Art. 20 GDPR. With regard to the right to information and the right of cancellation, the restrictions under Art. 34 and 35 new Federal Data Protection Act (BDSG) apply. In addition, there is a right of appeal to a data protection supervisory authority (Art. 77 GDPR in conjunction with Art. 19 Federal Data Protection Act (BDSG)).
